Please read these Terms and Conditions ("Terms") carefully before using the website located at https://proFixsolutions.com or engaging any services provided by ProFix Solutions ("Company", "we", "us", "our").
By accessing our website or booking our services, you agree to be bound by these Terms. If you do not agree, please discontinue use of our website and services.
1. Services
ProFix Solutions provides home maintenance and repair services including, but not limited to, plumbing, air-conditioning servicing, electrical work, renovation, handyman services, and waterproofing ("Services"). All Services are subject to availability and the specific terms agreed upon at the time of booking.
2. Bookings and Quotations
- All quotations provided by ProFix Solutions are valid for fourteen (14) days from the date of issue unless otherwise stated.
- A booking is confirmed only upon receipt of written acceptance of the quotation or a booking confirmation from us.
- We reserve the right to revise a quotation if the scope of work materially changes after the initial assessment.
- Emergency callout services may be subject to additional charges, which will be communicated to you prior to commencement of work.
3. Payment
- Payment is due upon completion of the service unless a credit account or instalment arrangement has been agreed in writing.
- We accept cash, online bank transfer, and major debit/credit cards. Accepted payment methods will be confirmed at the time of booking.
- Overdue invoices may attract a late payment charge of 1.5% per month on the outstanding balance.
- Title to any goods supplied as part of the Services does not pass to the customer until full payment has been received.
4. Cancellation and Rescheduling
- Cancellations made at least 24 hours before the scheduled appointment incur no charge.
- Cancellations made less than 24 hours before the appointment may incur a cancellation fee equivalent to one (1) hour of standard labour.
- We reserve the right to reschedule appointments due to circumstances beyond our reasonable control, including but not limited to severe weather, illness, or supply issues. We will notify you as soon as reasonably practicable.
5. Workmanship Warranty
ProFix Solutions provides a thirty (30) day workmanship warranty on all labour performed. This warranty covers defects arising directly from our work and does not cover:
- Damage caused by misuse, neglect, or third-party interference after completion.
- Pre-existing conditions unrelated to the scope of work carried out.
- Consumable items with a natural service life shorter than the warranty period.
Manufacturer warranties on parts and equipment are separate and subject to the respective manufacturer's terms.
6. Customer Responsibilities
- You must ensure safe and reasonable access to the property and the area of work at the agreed appointment time.
- You must disclose any known hazards (e.g. asbestos, concealed wiring, gas leaks) before work commences.
- You are responsible for obtaining any necessary consents, permits, or approvals required for the work, unless expressly agreed otherwise in writing.
7. Liability
To the fullest extent permitted by applicable law:
- ProFix Solutions's liability for any claim arising out of or in connection with the Services is limited to the total amount paid by you for the specific service giving rise to the claim.
- We are not liable for any indirect, incidental, consequential, or punitive loss or damage, including loss of profit, loss of use, or loss of data.
- Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be limited by law.
8. Intellectual Property
All content on this website — including text, graphics, logos, images, and software — is the property of ProFix Solutions or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
9. Privacy
Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
11. Changes to These Terms
We reserve the right to update these Terms at any time. The revised Terms will be posted on this page with an updated date. Continued use of our website or services after any changes constitutes your acceptance of the new Terms.
